What Is a Home Improvement Salesperson?

Under California Business & Professions Code §7152, a home improvement salesperson (HIS) is a person employed by a licensed contractor to solicit, sell, negotiate or execute home improvement contracts — or to install or furnish home improvement goods or services, including pools, hot tubs and spas. Anyone selling those contracts for a licensed contractor in California must register with the CSLB, regardless of the dollar amount, with only limited exceptions.

In the real world, that means a huge, growing pool of solar and home-improvement sales reps — the people knocking doors and sitting at kitchen tables across the state. The bar to register is low (you only have to be 18, with no experience, residency or education requirements), and since 2016 a registered salesperson can work for any number of contractors, with the contractor responsible for notifying CSLB. Where does the data come from?
Records are built from the California Contractors State License Board (CSLB) Home Improvement Salesperson registry — public registration records of salespeople employed by licensed California contractors — enriched with contact details for outreach.
What is a home improvement salesperson (HIS)?
Under California Business and Professions Code section 7152, a home improvement salesperson is a person employed by a licensed contractor to solicit, sell, negotiate or execute home improvement contracts — including swimming pools, hot tubs or spas — or to install or furnish home improvement goods or services. In practice this includes a large number of solar and home-improvement sales reps.
Who must register as an HIS with CSLB?
A person must register with CSLB if they solicit, sell, negotiate or execute home improvement contracts for a licensed contractor, regardless of the dollar amount of those contracts, with limited exceptions.
What are the exceptions to HIS registration?
Under BPC section 7152(c), registration is not required for: an officer of record of a licensed corporation, or a manager, member or officer of record of a licensed LLC; a general partner listed on a partnership license; a qualifying person as defined in BPC 7025; a salesperson whose sales are all made after buyer-initiated negotiations at a fixed general-merchandise retail establishment; a person who only schedules appointments for a registered HIS; and a bona fide service repairperson employed by a licensed contractor whose call is limited to the service or repair initially requested by the buyer.
What are the qualifications to become an HIS?
You must be at least 18 years of age. There are no experience, residency, or educational requirements — which is part of why this pool is so broad and so recruitable.
Can an HIS work for more than one contractor?
Yes. Once registered with CSLB, a salesperson may work for any number of contractors and sell a variety of goods and services. Since a law that took effect January 1, 2016, salespeople no longer register separately for each contractor — the licensed contractor notifies CSLB in writing before employing a registered HIS and within 90 days after employment ends, and the contractor's license must be current, active and in good standing.
